These terms apply to your use of checkproperty.co.za (“the Service”), which is operated by Active Wave Group (Pty) Ltd (“we”, “us”). By creating an account, buying a report or subscribing you agree to them. Please also read our Privacy Policy.
1. What the Service is
The Service compiles property reports (dossiers) on properties in Johannesburg, South Africa. All data is sourced from public sources, and each report shows the date its data was retrieved. A section appears in a report only when there is information for it, and the property page shows what a report contains before you pay.
2. What a report is not
The information in a report is indicative only and may be out of date. It is not a zoning certificate, a valuation or professional advice, and must be verified with the relevant authority before any decision is made.
- Zoning information and any assessment of development potential are a guide, not an approval or an entitlement.
- Sales figures are records of past transactions, not an estimate of value.
- Site-constraint findings are a desktop screen, not a geotechnical or floodline study.
- The calculators give estimates from standard formulas and the figures you enter.
- A report does not replace a conveyancer, town planner, land surveyor, valuer or engineer.
3. Accounts
You need an account to view or buy reports. You must be 18 or older, give a valid email address and keep your sign-in details confidential. You are responsible for activity on your account.
4. Products and prices
- Basic property report — R79, paid once, for one property.
- Development potential report — R299, paid once, for one property. If you bought the Basic report for the same property within the previous 7 days, you pay only the difference.
- Agent subscription — R369 per month, including 5 Basic property reports each month. Further reports cost R49 (Basic) and R269 (Development potential) each.
- Professional subscription — R899 per month, including 2 Development potential reports and 5 Basic property reports each month. Further reports cost R45 (Basic) and R229 (Development potential) each.
A free account may preview 5 properties a month. Extra previews can be bought once-off: 10 for R25 or 30 for R59. They are used only after the month’s free previews, re-opening a property already previewed that month uses none, and they do not expire. Plans include unlimited previews.
Prices are in South African rand and are the full amount payable; we are not registered for VAT and no VAT is charged. Reports included in a subscription that are not used expire at the end of each billing month and do not carry over. There is no minimum term. We may change prices for future purchases; a change never affects something you have already paid for.
5. Payment, renewal and cancellation
Payments are processed by PayFast. A report is a once-off payment. A subscription is charged every month on the anniversary of the day you subscribed until you cancel it. You can cancel at any time from your account page; cancelling stops all future charges, and until the end of the month you have already paid for you keep that month’s remaining included reports and the other plan features. Reports bought after you cancel are charged at the once-off price. If a monthly payment fails, the subscription ends at the end of the paid period.
6. Delivery and refunds
A report is digital content that is made available to you immediately after payment, at your request. Because it is delivered at once and cannot be returned, a report is not refundable once it has been opened or downloaded.
- If we are unable to deliver a report you paid for, or you are charged in error, we will refund you in full.
- If a report you paid for is missing a section that the property page said it would include, you may choose a refund of what you paid for it or a credit of the same value.
- A subscription payment is refunded in full if you ask within 7 days of the charge and no report has been unlocked with the subscription in that month.
- A pack of extra previews is refunded in full if you ask within 7 days and have used none of it.
- Nothing in these terms limits a right to a refund that the law gives you.
To ask for a refund, use the Contact support form in your account.
7. Licence to use a report
A report is licensed to you for your own purposes and for sharing with the parties to the transaction it relates to, such as your client, bank, attorney or other advisers. You may not resell reports or republish their contents in bulk. If you add your own branding to a report, the credit to checkproperty.co.za must remain.
8. Acceptable use
- Do not scrape, bulk-extract or resell data from the Service.
- Do not attempt to circumvent payment, usage limits or another user’s account.
- Do not upload branding or text that you do not have the right to use, or that is unlawful.
- Do not use the Service for any unlawful purpose.
We may suspend or close an account that breaks these terms.
9. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Information for a property is refreshed periodically, so a report reflects the position on the retrieval date it shows.
10. Limitation of liability
The Service and its reports are provided for information. To the extent the law allows, we are not liable for any loss or damage arising from reliance on a report or on the Service, including a property, financial or investment decision, and our total liability to you is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot lawfully be excluded, or limits your rights under the Consumer Protection Act 68 of 2008.
11. Changes to these terms
We may update these terms. The date at the top shows when they last changed, and continued use of the Service after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the Republic of South Africa.
13. Contact
For questions, complaints or notices, use the Contact support form in your account.
